Data-center law in Yemen

Yemen has no data-center-specific siting, permitting, or utility statute; the general investment regime of Law No. 15 of 2010 on Investment, promulgated by Decree No. 15 of 2010, is the applicable framework for a data-center project's registration and customs and tax incentives. The Law repealed the prior Investment Law No. 22 of 2002 and does not name information technology or data infrastructure as a distinct priority sector.

The Electricity Law, the Environment Protection Law, the Free Zones Law, and the Telecommunications Law are not described here, so their bearing on grid interconnection, environmental review, free-zone status, or telecommunications licensing is not covered by this summary. Article 28 grants an investment project established under this Law any incentives or advantages provided for in the laws in force.

Article 29(C) applies customs exemptions under the Customs Law to fixed assets imported to establish an investment or industrial project, including machinery, equipment, devices, transport and fishing vessels, and aircraft, on lists prepared by the General Authority for Investment, and exempts 50 percent of the customs duties on production inputs for a licensed and registered industrial investment project. Article 33 repeals the prior Investment Law No. 22 of 2002. The Law does not name information technology, data infrastructure, or a data center as a distinct sector or activity.
