Data-center law in United States Virgin Islands

The United States Virgin Islands has no data-center-specific siting or permitting statute. It offers two territorial incentive regimes a data center or technology operation could use. The Economic Development Commission program (29 V.I.C. ch. 12) grants benefits to a business investing at least $100,000 in an approved industry category, conditioned on Virgin-Islands-resident hiring, training, and other commitments.

The University of the Virgin Islands Research and Technology Park (17 V.I.C. ch. 34) declares the development of a territorial technology sector as its purpose and extends the same category of incentive to a qualifying Electronic Business or Knowledge-Based Business locating in the Park. Land-use, environmental-review, energy-grid, water-utility, and construction-permitting statutes for the territory are not described here.

The Virgin Islands Economic Development Commission grants benefits to a business investing at least $100,000, exclusive of inventory, in an approved industry or business category the Commission has determined advances the territory's economic well-being; a data center or technology operation could plausibly qualify under Category II (Product Assembly, Manufacturing, Repair and Maintenance and/or Export Operations) or Category IV (Designated Services Businesses, as defined in Section 703(g)).

A beneficiary must commit in writing to conditions including hiring and training Virgin Islands residents, notifying the territory's Employment Service of job openings, providing educational assistance or a contribution to the Territorial Scholarship Fund, and purchasing insurance from Virgin-Islands-licensed carriers where available; the Commission may impose monetary penalties for delinquent compliance reporting.

University of the Virgin Islands Research and Technology Park Act

This chapter declares the development of a technology sector in the Virgin Islands, through a research environment combining the University of the Virgin Islands, the public sector, and private industry, as its purpose, and establishes the University of the Virgin Islands Research and Technology Park to carry it out.

An Electronic Business, a Knowledge-Based Business, or a Person locating in the Park remains subject to Virgin Islands law and is intended to complement the Economic Development Commission program at 29 V.I.C. chapter 12 rather than duplicate it.
