Data-center law in Alaska

Alaska has no data-center-specific siting or tax-incentive statute; a data center proceeds under the state's ordinary, generally applicable permitting regime, several parts of which are structured differently than in the Lower 48. Land-use and zoning authority is areawide only in a first or second class (organized) borough; the unorganized borough, which covers most of the state's land area, carries no areawide zoning mandate under this chapter.
Because the state owns a majority of Alaska's land, a large facility sited on state land instead proceeds through the Department of Natural Resources' land-leasing authority. Construction is not governed by a single mandatory statewide building code; life-safety and fire-code minimum standards for commercial and industrial buildings are set by the Department of Public Safety's State Fire Marshal.
Cooling-water or wastewater discharge requires a Department of Environmental Conservation waste-disposal authorization, and an onsite generator fleet needs an air-quality construction or operating permit from the same department. A new or expanded electrical load large enough to require utility interconnection engages the Regulatory Commission of Alaska's certificate-of-public-convenience-and-necessity regime.
The Alaska Industrial Development and Export Authority can finance, or take an ownership stake in, a qualifying development project through its economic development account, the closest state-level analog to the incentive programs other states extend to data centers by statute.

A first or second class borough must provide for planning, platting, and land use regulation on an areawide basis, including zoning administered through a borough planning commission and a comprehensive plan the assembly adopts by ordinance. This duty is stated for a first or second class borough only; the chapter names no equivalent areawide planning or zoning duty for any other municipal classification.

State land management and leasing authority (Division of Mining, Land and Water)

The director of the Division of Mining, Land and Water has general charge and supervision of state land, prescribes application procedures for the sale, lease, or other disposition of available state land, resources, and property, and, under the conditions and limitations the commissioner imposes, issues deeds, leases, or other conveyances disposing of them. A person may not construct, modify, or operate a sewerage system or treatment works, or discharge solid or liquid waste material or heated process or cooling water into the waters or onto the land of the state, without prior authorization from the Department of Environmental Conservation.
Authorization may be an individual permit, a general permit for a category of disposal activity, or a regulation-based authorization; a data center's cooling-water discharge falls within this permitting requirement.

Applies to both
The Department of Public Safety must adopt regulations establishing minimum standards for fire detection and suppression equipment and for fire and life-safety criteria in commercial, industrial, business, institutional, and other public buildings. The commissioner may also charge fees for fire and life-safety plan checks made to determine compliance with these regulations.

Before constructing, installing, modifying, or establishing a stationary source subject to the department's applicability threshold, the owner and operator must obtain a construction permit from the Department of Environmental Conservation, and must separately obtain an operating permit before operating that source. An onsite generator fleet large enough to meet the applicability threshold requires these permits.

The Alaska Industrial Development and Export Authority may use its economic development account to finance, acquire, manage, and operate a development project the authority intends to own and operate, or to provide development project financing for a project it does not intend to own and operate. The authority adopts regulations governing the application process, fees, interest rates, and other terms for a development project it undertakes or finances under this section.
