Data-center law in Trinidad and Tobago

Trinidad and Tobago's data-centre-relevant statute is the Trinidad and Tobago Special Economic Zones Act, 2022 (Act No. 1 of 2022), which repealed the former Free Zones Act, Chap. 81:07, and establishes a licensing and fiscal-incentive framework a data-centre operator could use rather than a siting, permitting, or utility-specific statute.

The Act was assented to and partially proclaimed on 31 January 2022 to set up the Trinidad and Tobago Special Economic Zones Authority, and was fully proclaimed on 5 July 2024, bringing its licensing and benefits provisions into force and the Special Economic Zones Regulations, 2023 into effect.

No provision of the Act addresses electricity grid interconnection, water use, or air emissions specifically, and those matters remain governed by Trinidad and Tobago's general utility and environmental law.

The Act establishes the Trinidad and Tobago Special Economic Zones Authority, which may designate a geographical area as a Special Economic Zone and license an operator or an enterprise, public, private, or a public-private partnership, to carry on business within one. The Authority itself is exempt from all taxation of every kind, including corporation tax and value added tax (s. 29).

An SEZ enterprise's benefits, listed in Schedule 2, include reduced corporation tax, reinvestment and research-and-development allowances, zero-rating of goods and services supplied to the zone under the Value Added Tax Act, and customs-duty exemption on approved capital goods and materials for use in the zone, while an operator's benefits under Schedule 1 include property tax and stamp duty exemptions.

The Act was assented to and partially proclaimed on 31 January 2022 to establish the Authority, and fully proclaimed on 5 July 2024, repealing the Free Zones Act and bringing the licensing and benefits provisions described here into force.
