Data-center law in Sierra Leone

Sierra Leone has no data-center-specific siting, permitting, or utility statute; a data-center project is governed by the general investment framework of the Sierra Leone National Investment Board Act, 2022. That Act establishes a National Investment Board and repeals the two Acts that previously performed this function, the Investment Promotion Act 2004 and the Sierra Leone Investment and Export Promotion Agency Act 2007.

It authorises the Board to offer incentives to promote strategic or major investment and directs its Secretariat to issue guidelines specifying priority areas for investment, but the Act itself does not name information technology or data infrastructure as a priority sector, and no provision addresses electricity grid interconnection, water use, or air emissions specifically.

The National Investment Board Act, 2022 establishes a National Investment Board, chaired by the President, as the highest policy-making body on investment in Sierra Leone, with a Secretariat headed by an Executive Director to promote, facilitate, and register domestic and foreign investment.

Section 30 empowers the Board to offer incentives, in addition to existing laws, to promote identified strategic or major investment, and section 32 directs the Secretariat, in consultation with the Board, to issue guidelines and specify priority areas for investment; those guidelines are not part of the Act itself.

Section 52 repeals the Investment Promotion Act 2004 and the Sierra Leone Investment and Export Promotion Agency Act 2007, the two Acts that previously governed investment promotion and incentives, while preserving the property, assets, rights, and interests of the bodies the repealed Acts created.
