Data-center law in Luxembourg

Luxembourg has no data-centre-specific statute; a data centre project is governed by four general regimes. The classified-establishments law requires an operating authorization graded by class before an installation with environmental or nuisance risk, which a data centre's generators and cooling plant typically trigger, may begin operating or be constructed.
Where the project's nature, scale or location meets the thresholds a grand-ducal regulation sets, the environmental impact assessment law requires a separate assessment whose conclusion feeds into that authorization. The electricity market law obliges the relevant network operator to connect any applicant located in its zone, and the municipal land-use planning law confines siting to the zones a commune's general development plan designates for the intended use.
No dedicated data-centre energy-efficiency reporting duty transposing the recast Energy Efficiency Directive, and no water-utilities statute specific to a data centre's cooling-water use, has been located in the sources checked.

Each commune must maintain a general development plan (plan d'aménagement général), prepared by the commune's college of mayor and aldermen and approved by the Minister of the Interior. The plan divides the whole of the commune's territory into zones and fixes each zone's permitted use.

Before a public or private project likely to have significant effects on the environment, by reason of its nature, dimensions or location, may be authorized, its developer must complete an environmental impact assessment. A grand-ducal regulation lists the project categories subject automatically or by case-by-case screening.
A data centre project meeting the listed thresholds must complete this assessment, and the competent environmental authority's reasoned conclusion on the project's effects must be integrated into the authorization decision, including the classified-establishment authorization the project may also need.

Every industrial, commercial or craft establishment, public or private, whose existence or operation may create a danger, nuisance or inconvenience to public health, safety, the workforce or the environment must hold an operating authorization before starting activity. A grand-ducal regulation sets the establishment's class and nomenclature.
The class determines the authorizing authority, ranging from the joint Minister of Labour and Minister of the Environment for the highest class down to the commune's mayor for class 2.
