Data-center law in Jamaica

Jamaica has no data-center-specific siting, permitting, or utility statute; a data-center project locating in a designated Special Economic Zone is governed by the general incentive and zone-administration framework of the Special Economic Zones Act, 2016, which repealed the earlier Jamaica Export Free Zones Act.

The Act is sector-neutral: it grants tax and customs relief to a developer or occupant operating within a designated Zone under a master-concession or licence-agreement, without naming data centers or information technology as a distinct priority sector, and no provision addresses electricity grid interconnection, water use, or air emissions specifically beyond a general duty to protect the environment in the course of a Zone's development and operation.

The Act repeals the Jamaica Export Free Zones Act and establishes the Special Economic Zone Authority, a body corporate that regulates and supervises designated Zones, negotiates master-concessions and licence-agreements with developers, and approves subconcessions with occupants.

A developer or occupant conducting business within a Zone receives income-tax relief, including a reduced 12.5% rate on chargeable trade income, an exemption on dividend income, and a promotional tax credit for research, development, and training expenditure, alongside customs-duty relief on imported inputs.

The Act applies to Special Economic Zones established in Jamaica and is administered as a customs enactment; it does not name data centers, information technology, or any other sector by category, and its environmental duties are stated generally rather than through a dedicated permitting regime for utilities, grid interconnection, or emissions.
