Data-center law in Grenada

National jurisdiction · as of 2026-09-05

Grenada has no data-center-specific siting, permitting, or utility statute; a data-center project is governed by the general investment-incentive framework of the Grenada Investment Promotion Act, Chapter 131B of the Revised Laws of Grenada, originally enacted as Act No. 22 of 2009.

That Act repealed four prior incentive statutes (the Hotels Aid Act, the Fiscal Incentives Act, the Qualified Enterprises Act and the Investment Code Incentives Act) and channels tax and duty incentives through a certification process run by the Grenada Industrial Development Corporation, without naming information technology or data infrastructure as a distinct priority sector.

Secondary commentary (the United States Department of State's Investment Climate Statements) describes Grenada as having passed a further Investment Promotion Act in 2014 that superseded the 2009 Act, and an incentives-codification reform in 2016; no primary text of either is described here, so Chapter 131B is the only primary source described, and a later pass should confirm whether Chapter 131B is still current or has been superseded. No provision addresses electricity grid interconnection, water use, or air emissions specifically.

Grenada Investment Promotion Act

Enacted, not yet in force

Grenada Investment Promotion Act, Chapter 131B, Revised Laws of Grenada (originally Act No. 22 of 2009)

Applies to both

The Grenada Investment Promotion Act, originally enacted as Act No. 22 of 2009 and consolidated as Chapter 131B of the Revised Laws of Grenada, promotes and facilitates investment by certifying eligible business enterprises for tax and duty incentives under the Income Tax Act, the Customs Tariff and other applicable law, through the Grenada Industrial Development Corporation (GIDC) acting as a one-stop centre for investors.

It repeals four prior incentive statutes (the Hotels Aid Act, the Fiscal Incentives Act, the Qualified Enterprises Act and the Investment Code Incentives Act) and gives the Minister power to reserve certain business activities to local investors. Section 1(2) delays the Act's commencement to a day the Governor-General fixes by Proclamation, and the consolidated text itself is marked as awaiting proclamation.

Secondary sources (the United States Department of State's Investment Climate Statements) describe Grenada as operating under a further Investment Promotion Act passed in 2014, not located here in primary form, so it is unclear whether Chapter 131B or a later enactment is the currently governing text.
