Data-center law in Federated States of Micronesia

The Federated States of Micronesia has no data-center-specific siting, permitting, energy-grid, or water-utility statute; a data-center project would fall under the general foreign-investment framework of the Foreign Investment Act of 1997 (Title 32, Chapter 2 of the Code), which regulates a noncitizen investor's entry into any business rather than a particular sector.

The Federated States of Micronesia Environmental Protection Act (Title 25, Subtitle II, Chapter 5, PL 3-83) establishes a general environmental-policy framework enforced by the FSM Environmental Protection Board, but its general-provisions chapter, as read, states only broad environmental-stewardship policy and does not itself set out a project-level environmental-review or permitting procedure that a data-center developer would follow.

The Foreign Investment Act of 1997 (Public Law 10-49) governs a foreign investor's entry into any business in the Federated States of Micronesia, including a data-center project. It guarantees that a holder of a Foreign Investment Certificate will not have its property compulsorily acquired or expropriated except in narrow, compensated circumstances, and guarantees the right to repatriate capital and transfer earnings.

It also guarantees non-discriminatory treatment as against a citizen-owned business. The Act does not create a tax exemption, subsidy, or other affirmative incentive for information-technology or data infrastructure specifically; its own effectiveness section ties commencement to the ninetieth day after presidential approval, and the sources read do not state the calendar date this occurred.
