The State of Goiás has no data-centre-specific siting, permitting or utility law; a data-centre project meets the state's general environmental-licensing and water-use laws, alongside the federal and municipal rules the national document for Brazil describes.

Lei nº 20.694, de 26 de dezembro de 2019, makes the construction, installation, expansion and operation of a polluting or potentially polluting undertaking depend on prior environmental licensing, in a process integrated with the water-use grant. Lei nº 13.123, de 16 de julho de 1997, requires a grant (outorga) before public waters under state domain are diverted, and makes drilling a deep well without authorization an infraction. Land use and building follow the plano diretor and the building rules of the municipality where the facility is sited.

Environmental Licensing General Rules Law of the State of Goiás

In force

Lei nº 20.694, de 26 de dezembro de 2019

Effective 2019-12-27 · Applies to both

Lei nº 20.694, de 26 de dezembro de 2019, which sets general rules for environmental licensing in the State of Goiás, entered into force on 2019-12-27, the date of its publication in the state official gazette. The construction, installation, expansion and operation of undertakings and activities that use environmental resources or are effectively or potentially polluting or capable of causing environmental degradation depend on prior environmental licensing.

The licensing is carried out in a process integrated with the water-use grant, the authorization to remove vegetation, the authorization to collect, capture and manage fauna, and the consent of the managing body of a conservation unit. Licensing may result in seven types of licence: prior, installation, operation, single environmental, by adhesion and commitment, corrective, and expansion or alteration.

Municipalities license activities and undertakings that cause or may cause environmental impact of local scope, as typified by the state environmental council, or that are located in conservation units the municipality instituted, except environmental protection areas. The licensing body may require periodic environmental audits and, for an activity of high risk as defined in the environmental impact study, a civil-liability insurance policy for environmental damage.
