Data-center law in Bangladesh

Bangladesh has no data-center-specific siting, permitting, or utility statute; a data-center or hi-tech industrial project instead falls under the Bangladesh Hi-Tech Park Authority Act, 2010 (Act No. 8 of 2010), which since a 2014 amendment defines a "Park" to include an IT park, IT village, technology park, software technology park and similar government- or privately-designated zones, and "hi-tech industry" to include information-technology, software-technology and IT-enabled-services undertakings.

The Authority created by the Act allots land or building space to permitted investors, runs a one-stop service for permits and utility connections, and the Government may grant special customs duty exemptions to a hi-tech factory established in a Park and may, by gazette notification, suspend the application of other laws inside a Park to attract investment.

No provision addresses environmental review, electricity grid interconnection, or water use as a distinct regulatory step beyond the one-stop service's utility-connection facilitation.

Sections 17 to 20 require a person seeking to establish a Park, or to establish a hi-tech industry within a Park, to apply to the Authority for permission, which is non-transferable once granted; the Authority may instead appoint a Developer to build a Park's physical infrastructure.

Section 21 lets the Authority run a one-stop service covering permission to select land in the Park, resident and non-resident visas, work permits, construction permits, allotment, rent or lease of plots for a hi-tech industry, and connection and supply of water, gas, electricity and telephone.

Section 22 lets the Government, by gazette notification, declare a place a Park, and section 23 lets the Authority allot, rent, or lease land or building space in the Park to a permitted investor, subject to conditions, with the allotment voidable if the land is used for a purpose other than the hi-tech industry it was granted for.

Section 27 lets the Government, by gazette notification, suspend the application of any other law inside a Park, or apply it there only as modified, in the interest of attracting investment.

Section 14 lets the Authority, notwithstanding any other law, establish and operate public warehouses under the Customs Act, 1969 for a hi-tech factory's imported raw materials, packaging, and semi-processed goods. Section 15 lets the Government, by gazette notification, grant special customs duty facilities to a hi-tech industrial factory established in a Park, and introduce special import and export arrangements for it under the Customs Act, 1969.

Section 16 lets the Authority, with the consent of the National Board of Revenue, grant bonded facilities exempting a Park's imported raw materials from customs reserve, sales tax, octroi, excise duty, import licence or permit fees, and exempting goods exported from or used within the Park from duty or other charges.
