Data-center law in Azerbaijan

Azerbaijan has no data-center-specific siting, permitting, or environmental-review statute; the applicable regime is the general Law on the Alat Free Economic Zone, No. 1143-VQ (signed 18 May 2018, in force 6 June 2018), which creates a bespoke legal territory southwest of Baku with its own land-use, tax, customs, labour, and utility rules that displace ordinary Azerbaijani law wherever the two conflict.

A data-center project locating inside the zone as a Free Zone Legal Entity is exempt from all taxes related to its activity there (Art. 16.1) and from customs duties on goods and vehicles moved into the zone (Art. 17), while the Free Zone Authority holds an irrevocable and perpetual right of use over the Free Zone Land and grants, leases, or otherwise disposes of parcels to residents and developers under its own internally issued regulations rather than the ordinary national land code (Art. 19).

The Authority's Internal Regulations, not primary legislation, govern environmental standards, energy and water utility coordination, and construction and operation within the zone (Art. 6.2.5), so no primary-legislation environmental-review, energy-grid, water-utilities, construction, or air-operations rule of general application to a data center was located outside the zone framework.

No dedicated ICT or data-centre investment-incentive statute distinct from the Alat Free Economic Zone regime was located.

Art. 2 establishes the Free Zone on land the relevant executive authority delineates (the Free Zone Land). Art. 19.1 grants the Free Zone Authority an irrevocable, unfettered, and perpetual right of use over that land, and Art. 19.2 lets the Authority use, lease, or otherwise dispose of any part of the Free Zone territory, including allocating land to a Developer for construction and infrastructure.

Art. 19.3 requires the Authority to issue Internal Regulations governing land development, the creation and termination of rights of disposal over Free Zone Land, and a Registry recording those rights, in place of the ordinary national land code. A data-center developer's site-control, lease, and permitting path inside the zone runs through this Authority-issued land regime rather than a municipal or national land-use process.

Art. 16.1 exempts the Free Zone Authority, its Administrative Entities, and Free Zone Legal Entities operating in the zone from all taxes related to their activities there, and treats the supply of goods, works, and services between the Free Zone and the rest of Azerbaijan (the Base Economy) as an import or export for tax purposes.

Art. 17 applies the Base Economy's customs regime to goods and vehicles moved between the zone and the Base Economy by a Base Economy taxpayer, while the Free Zone Authority establishes its own customs body and issues Internal Regulations governing clearance, fees, and the use of customs agents within the zone.

A data center established as a Free Zone Legal Entity, including one importing server or networking equipment, falls within this exemption and customs regime rather than the ordinary national one.
