Data-center law in Antigua and Barbuda
National jurisdiction · as of 2026-09-05
Antigua and Barbuda has no data-center-specific siting, permitting, environmental-review, or energy-grid statute; a data-center project is governed by the jurisdiction's general investment-incentive framework.
The Antigua and Barbuda Investment Authority Act, 2006 (No. 15 of 2006) is the framework the WTO's most recent Trade Policy Review of Antigua and Barbuda identifies as the country's principal, currently operating incentive scheme, offering customs-duty and tax relief scaled to the size of a capital investment; the review names infrastructure development and renewable energy among the sectors eligible for its largest investment category.
A Free Trade and Processing Zone Act, 1994 and a Special Economic Zone Act, 2015 also remain in force as parallel incentive regimes, but neither Act's own gazetted text is confirmed among the sources read here, so neither is recorded as an instrument.

In force
Investment Authority Act, 2006 (No. 15 of 2006)
Applies to private
The Antigua and Barbuda Investment Authority Act, 2006 establishes the Antigua and Barbuda Investment Authority and lets it grant a qualifying investor customs-duty and tax relief, scaled by category to the size of the capital investment, on equipment, building materials and vehicles used in a project, plus reductions or exemptions on corporate income tax, withholding tax, property tax and stamp duty on land transfers.
Since 2019, the Act's largest investment category (over XCD 150 million) is oriented to selected sectors including healthcare, tourism, infrastructure development, renewable energy and education, so a sufficiently large data-center project could fall within that category if characterised as infrastructure development or a similar economic-development project; the Act does not name data centres, computing infrastructure, or information technology as a distinct eligible sector.
